Town Board Meeting Minutes 08/04/21

TOWN OF BROWNVILLE                                      TOWN OFFICE, LIMERICK, N.Y.

TOWN BOARD                                                         AUG. 4, 2021, 5:00 PM

 

PRESENT:    Roll call of Board Members:

Supv. Richard D. Lane, Councilmen Ron Tepfenhart, Albert Roberts,

Richard Dodge, Jeff Timerman, Supt. Roy Gilchrist and Clerk June

McCartin.

 

ABSENT:      No One

 

MINUTES:   Motion from Councilman Dodge to accept the July minutes as

received and Councilman Tepfenhart seconded the motion.  Agreed.

 

FINANCIAL

STATEMENT:  Councilman Dodge motioned to accept the financial report as

provided and Councilman Tepfenhart seconded the motion.  Agreed.

.

PUBLIC HEARINGS:  The Clerk read the notice of public hearing scheduled for 5:00

PM on proposed local law to opting out of licensing and establishing retail

cannabis dispensaries and/or on-site cannabis consumption establishments

within the Town of Brownville.  No one was present to speak for or against

the proposed local law.  Hearing closed at 5:05 PM.  Agreed.

 

BIDS:          None

 

COMMUNICATIONS:

 

Incoming:  1. Received letter from NYS DOT extending the existing 45 MPH

speed zone for a portion of Allen Road by 750 feet to the northeast.

Outgoing:  None

 

COMMITTEE REPORTS:

  1.                    Planning Board Minutes
  2. Ron’s monthly land use reports
  3.         Copy of transfer site tonnage of refuse and recyclables
  4. Monthly dog report

 

UNFINISHED BUSINESS:

  1. Motion made by Councilman Dodge to change order WD#2 by

$393,177.95 for overrun on road work.  Councilman Roberts seconded

the motion with Supv. Lane signing the order.  Agreed.

 

NEW BUSINESS:

  1.       Councilman Roberts motion to opt out of licensing and establishing

retail cannabis dispensaries and/or on-site cannabis consumption

establishments within the Town of Brownville. Councilman Timerman

seconded the motion.  Agreed.

  1. Received letter from NYS American Rescue Plan Act (ARPA). Town

eligible for up to $353,734 subject to cap of 75 percent of town budget.

Application has been submitted.

  1. Councilman Dodge motioned to reappoint Sherman Tucker to the

BAR with term to expire 9/30/2026.  Councilman Roberts seconded the

motion.  Agreed.

  1.              Councilman Tepfenhart motioned to reappoint Tanya Caprara to the

ZBA for a term to expire 7/31/2025.  Councilman Timerman seconded

the motion with all agreeing.

 

HIGHWAY SUPT.  Supt. Gilchrist reports road work on Game Farm Road and Moffatt

Road and paving on CR59.  The town mower is again in the shop for

repairs.  Supt. Gilchrist request replacing the mower for next years

budget.  He will get quotes.  He has quotes for a scraper for a plow

truck for hard packed ice from Viking for $7,799.00 installed.

Councilman Tepfenhart motion to proceed with the purchase and

Councilman Roberts seconded the motion.  Agreed.

 

CLERK:                   Clerk report for July given.  Councilman Timerman motioned to

                                 accept report and Councilman Roberts seconded the motion. 

                                 Agreed.  

                                 Clerk read a letter from Ron and Mary Thomas requesting the Stone

                                 Road between the Middle Road and CR 59N be posted non usage to

                                 off road vehicles and snowmobiles from using any part of the road

                                 or its banks. NYS has all roads closed to these vehicles by State Law.

                                 Town has no jurisdiction. 

 

COUNCILMEN:     Councilman Dodge request a change in Town Code to allow shed,

garages, etc. placement on lots without a residence.  Request will go

to Planning Board for their consideration.

TOWN SUPERVISOR: 1. Nothing further

 

WATER,

GENERAL AND

HIGHWAY BILLS:   Board Members reviewed the payables.  Councilman Tepfenhart

motioned to pay the General Bills ($33,781.51), the Highway

bills ($187,676.91) and the water bills ($21,616.59).  Councilman

Dodge seconded the motion.  Agreed.

 

 

 

 

 

 

ADJOURNMENT:    Councilman Tepfenhart motioned to adjourn at 6:02 PM and

Councilman Timerman seconded the motion.  The next town board

meeting has been scheduled for 5:00 PM on Sept. 1, 2021
